Welcome to SnoreScore: Snore Tracker App (the "App" or "Service"), developed and operated by Denys Mylymko ("we," "our," or "us"). By downloading or using the App, you agree to these Terms of Use (the "Terms"). Please read them carefully.

If you do not agree with these Terms, please stop using the App immediately.

1. License to Use

We grant you a limited, non-exclusive, non-transferable and non-sublicensable licence to download and use the App on a device you own or control, solely for personal, non-commercial purposes. All intellectual property rights in the App remain with Denys Mylymko.

You must not:

• copy, modify, distribute, or create derivative works based on the App;
• reverse engineer, decompile, or attempt to extract the source code of the App;
• use the App for commercial purposes, resale, leasing or sublicensing;
• use automated tools, bots or scripts to access or interact with the App.

Violation of these restrictions terminates your licence immediately.

2. Health Disclaimer — Not a Medical Device

SnoreScore is a general wellness tool. It is not a medical device.

• The App does not diagnose, treat, monitor or prevent any medical condition, including sleep apnea.
• Snoring detection works by measuring sound level. It can miss snoring, and it can mistake other night-time sounds — a fan, traffic, a partner, a pet — for snoring.
• Loudness values shown in the App are relative and approximate. They are not calibrated decibel measurements and should not be compared against clinical or occupational thresholds.
• Your Snore Score is an index produced by the App's own formula for comparing your nights with one another. It is not a medical score and cannot be compared with figures from other apps or devices.

Do not use the App to make medical decisions. If you suspect sleep apnea or any other disorder, or if someone tells you that you stop breathing during sleep, consult a qualified healthcare professional. Never disregard or delay professional advice because of anything you have seen or heard in the App.

The App is not intended for anyone under the age of 16.

3. How the App Works, and What It Requires

To record a night, the App needs:

• Microphone access. It is the only permission the App cannot work without. You grant it through the system prompt and can revoke it at any time in iOS Settings.
• The App to remain open. Recording continues while the screen is locked, but if you close the App the session ends.
• Battery. An overnight recording will drain an unplugged phone. Keep the device on a charger.
• Free storage. Audio clips need space. If the device is full, clips cannot be saved.

A recording session has a maximum length. If you do not stop a session yourself, the App stops and saves it automatically once that limit is reached.

4. Subscriptions and Purchases

4.1 Access Tiers

• Free. Record every night and receive your Snore Score and morning report. History is limited to the two most recent nights, and playback is limited to the three loudest clips of each night.
• Premium (monthly or annual subscription). Unlimited history, up to twenty clips a night, trends, the weekly report, and the breakdown of the factors that accompany your better and worse nights.
• Premium (one-time purchase). The same Premium features, bought once rather than by subscription, for as long as the App remains available on your Apple ID.

Where an introductory free trial is offered, its length and the price that follows are shown on the purchase screen before you confirm.

4.2 Prices

Prices are shown in your local currency on the purchase screen inside the App before you confirm, and may differ between countries and over time. The price displayed at the moment of purchase is the price that applies.

4.3 Billing and Renewal

• All purchases are processed by the Apple App Store and are subject to Apple's payment terms.
• Your Apple ID is charged on confirmation of purchase.
• Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your account is charged for renewal within the 24 hours before the period ends.
• You can manage or cancel a subscription at any time in your Apple ID account settings under Subscriptions. Deleting the App does not cancel a subscription.
• Any unused portion of a free trial is forfeited when you purchase a subscription.
• Refunds are handled by Apple under Apple's policies. We cannot issue refunds for App Store purchases; please contact Apple Support.

4.4 Restoring Purchases

The purchase screen offers "Restore purchases", which recovers a purchase made previously with the same Apple ID — for example after reinstalling the App or moving to a new device.

5. Your Data

Your recordings and the results calculated from them stay on your device and are never uploaded to us. The Privacy Policy explains this in full, along with the limited information that does leave your device: purchase verification, anonymous usage statistics and crash reports.

Deleting the App removes the recordings and results stored on that device. If you want them gone but want to keep the App, use Settings → Delete all data.

You are responsible for your own backups. We hold no copy of your nights and therefore cannot restore anything you delete or lose.

6. Recording Other People

A recording made beside your bed may capture the voice or the snoring of anyone else in the room. You are responsible for complying with the laws of your country regarding the recording of other people, and for obtaining their agreement where it is required. Do not use the App to record a person who has not agreed to it.

7. Acceptable Use

You agree not to use the App in ways that:

• violate any applicable law or regulation;
• infringe the rights of any third party, including privacy and intellectual property rights;
• interfere with or attempt to disrupt the App or the services it relies on;
• attempt to gain unauthorised access to any part of the App or to another user's data.

8. Disclaimer of Warranties

The App and all of its features are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied. We do not warrant that:

• the App will operate without interruption or error;
• a recording will start, continue, or survive an interruption such as an incoming call, a system alarm, a low battery, or the device running out of storage;
• snoring will be detected accurately, or detected at all;
• the figures the App reports are accurate for any particular purpose.

To the fullest extent permitted by law we disclaim all warranties of merchantability, fitness for a particular purpose and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Denys Mylymko is not liable for:

• any health outcome or decision arising from reliance on the App's measurements or score;
• a night that was not recorded, was recorded incompletely, or was lost;
• loss of data, device malfunction, or battery consumption;
• indirect, incidental, special, consequential or punitive damages arising from your use of, or inability to use, the App.

Liability cap. Our total liability under any circumstances is limited to the amount you paid for the App in the twelve months preceding the claim.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud. Where you deal with us as a consumer, your statutory rights are unaffected.

10. Indemnification

You agree to indemnify and hold harmless Denys Mylymko from any claims, damages, losses or costs (including reasonable legal fees) arising from your misuse of the App, your breach of these Terms, or your infringement of the rights of a third party — including any claim arising from recording another person without their agreement.

11. Modifications to the App and to These Terms

We may add, change or remove features at any time, and may stop supporting the App entirely. We may update these Terms; the revised version will carry a new effective date, and material changes will be announced in the App before they take effect. Continuing to use the App after that date constitutes acceptance of the updated Terms.

12. Termination

These Terms remain in effect until terminated by you or by us. You may terminate at any time by deleting the App. We may suspend or terminate your access if you breach these Terms. Provisions concerning intellectual property, disclaimers, limitation of liability, indemnification and dispute resolution survive termination.

13. Dispute Resolution and Governing Law

If a dispute arises out of or relating to these Terms or your use of the App, both parties agree first to attempt resolution through good-faith negotiation. Written claims must be answered within 21 business days of receipt.

If the dispute cannot be resolved informally, it is subject to the laws of the jurisdiction in which Denys Mylymko is registered, and to the competent courts of that jurisdiction. If you are a consumer resident in the European Union, this does not deprive you of the protection of the mandatory provisions of the law of your country of residence.

14. Apple

These Terms are between you and Denys Mylymko, not with Apple. Apple is not responsible for the App or its content, and has no obligation to provide support or maintenance for it. Apple is not responsible for addressing any claim relating to the App, including product liability, regulatory compliance, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
